Amendments aimed at carving out exemptions for rape, incest and the health of women were rejected.

...Damn.

Hello, theocracy.

Supporters are pushing the measure in hopes of drawing a legal challenge that will cause the US Supreme Court to reverse its 1973 decision legalizing abortion.

We need to get the word out to the goodly people of South Dakota -- don't fight, RUN!

Meh, does anyone actually live in South Dakota?

Hi there!

Of course, this means that if I move to South Dakota, I can totally make a killing on black market back alley abortions!! I mean previously, I'd have needed actual medical experience. But now, hell, I'm golden!

[livejournal.com profile] kraorh contends (and I agree) that this bill will buckle under the first constitutional challenge.

have you seen the supreme court lately? from what i've heard, it was already basically impossible to get an abortion in south dakota. making it law doesn't change a thing there, except it goes exactly against what the supreme court previously decided against, which means that if it gets challanged they get to decide on it again.

That'll never fly. It's just Roe Vs. Wade all over again, and the Supreme Court decided that one already.

The Supreme Court hasn't decided anything on this case yet. It just passed the state house. When someone contests it, then it'll go to court. We are talking about South Dakota here, though. It might not ever come up.

We do have a Republican majority in the Supreme Court now and didn't when Roe v. Wade was decided, but they'd be foolish to completely overturn it. People would be pissed, pregnant teens would die in the alleyways, and they know it. Maybe they would... I guess we'll find out.

I understand that in general...there was like only one place in that entire state to get an abortion, practically making it so the ban was in place before hand.

It's disturbing to even think about, but I wonder how they plan to enforce the exceptions? Like would a woman have to have actually won a court case that she was raped in order to get an abortion? That would be pretty damn scary besides the fact that I think the court case could run over 9 months time pretty easily.

Speaking as a North Dakotan, I maintain that South Dakotans are fucking morons, period. I mean, who the hell votes out their senate representative for no good reason when he's the fucking majority leader?? Actually, I'm starting to think the republican party just killed everyone in the state and now have "the people of South Dakota" do whatever the administration want.
